DATA PROCESSING

AQIPTECH AG processes any data that you provide through online forms or when contacting us by any other means (telephone, e-mail, apps, correspondence, etc.), data that is automatically left behind when you visit and use the website or data that AQIPTECH AG receives or collects itself from customers and other business partners or their respective contact persons and employees and other persons involved, authorities or from public sources within the framework of business relationships with them.

If you pass on to us data about other persons, we will assume that you are authorised to do this and that the data transmitted is correct. We therefore kindly ask that you inform the third parties in question that you have transmitted their personal data to us and refer them to the current data protection declaration.

PURPOSES OF DATA PROCESSING AND PROCESSING FUNDAMENTALS

The data that AQIPTECH AG processes includes a variety of personal data such as general contact details (name, home address, additional address details, telephone/mobile phone number, email address), data for invoicing and payment purposes as well as other personal data in connection with your enquiry, consultation, offer processing and business transactions.

AQIPTECH AG uses this personal data in particular,

• to respond to enquiries and provide information that you or relevant third parties require;
• to prepare, conclude and process contracts with customers and business partners, in particular within the framework of consulting and the provision of services, the purchase of products and services from suppliers and subcontractors;
• to inform customers, business partners or other interested parties about events, news, services or products that could be of interest to them, or to send Christmas cards and gifts, provided that no objection to this communication has been raised, which can be done at any time, or
• for quality control purposes.
• It may be possible for other purposes to arise from the circumstances or to comply with legal or other regulatory provisions and internal guidelines or when indications arise when collecting the data in question.

To the extent that you have given us your consent to process your personal data for specific purposes (for example, when registering to receive newsletters or when making an enquiry using the contact form), we shall process your personal data within the framework of and based on this consent, provided we have no other basis for processing and we require such a basis. Any consent given may be revoked at any time for the future, although this has no effect on data processing that has already taken place. In cases where we do not request your consent for any processing, we shall base the processing of your personal data on the fact that the processing is necessary to initiate or fulfil a contract with you (or the body or person you represent) or that we or third parties harbour a legitimate interest, in particular for pursuing the purposes described above and the associated objectives and to be able to implement corresponding measures.

TECHNOLOGIES FOR ADVERTISING PURPOSES

We use the remarketing technology of Google. In the process, users who have visited our website and online services are addressed again through targeted advertising on the pages of the Google Partner Network. Advertising is displayed through the use of cookies. User behaviour when visiting the website can be analysed with the help of these cookies and then be used for targeted product recommendations and interest-based advertising. SSL/TLS ENCRYPTION

This website uses SSL/TLS encryption to ensure security and to protect the transmission of confidential content, such as enquiries that you send to us as the site operator. An encrypted connection can be recognised by the fact that the address line of the browser changes from http:// to https:// and by the lock symbol in your browser bar.
The data you transmit to us cannot be read by third parties if SSL or TLS encryption is activated.

DATA TRANSFER TO THIRD PARTIES AND DATA TRANSFER ABROAD

It may be necessary for AQIPTECH AG to pass on personal data to external service providers (such as hosting/IT providers, support, suppliers, subcontractors and other business partners) to achieve the purposes described in this data protection declaration. These sites are not only located in Switzerland. Your data may be processed both in Europe and, in exceptional cases, in any country in the world. Personal data is processed and retained in Switzerland within the area of responsibility of AQIPTECH AG. We generally agree contracts with our contract processors regarding the use and protection of personal data and require them to comply with a suitable level of data protection when processing data in a foreign country. Precautionary contractual measures cannot, however, exclude all risks (especially government access abroad). You should be aware of these residual risks, despite the fact that the risk may be low in individual cases.

DURATION OF DATA RETENTION

Personal data shall only be stored (and then deleted or anonymised) for as long as this is necessary for the processing of the order or within the framework of relationship management, if there is a legal obligation to retain and document data or if AQIPTECH AG has a prevailing private or public interest in doing so or if this is technically necessary since data cannot be separated from other data and this therefore has to be stored with it (e.g. in the case of backups or DMS). AQIPTECH AG undertakes proportionate and reasonable precautions so that personal data is protected against loss, unauthorised modification or unauthorised access by third parties.

DATA SECURITY

AQIPTECH AG works together with hosting providers to take appropriate technical and organisational security precautions to protect the confidentiality, integrity and availability of your personal data, to protect it against unauthorised or unlawful processing and to counteract the risks of loss, unintentional modification, unwanted disclosure or unauthorised access.
We would like to point out that data transmission over the Internet (e.g. during e-mail communication) may be subject to security flaws. It is not possible to fully protect data against access by third parties. You are responsible for informing AQIPTECH AG of your request for special security measures.

RIGHTS OF THE DATA SUBJECT

The data subject has, in particular, the right to information about the personal data stored about them and for what purpose the data is processed, the right to rectification, deletion or restriction of the processing of their personal data, the right to object to the processing and the right to data transfer/portability. However, please note that prerequisites and exceptions apply to these rights. We may refuse requests to exercise these rights where permitted or required by law. For example, we are permitted or required to retain or otherwise continue to process personal data despite a request to delete the personal data or restrict processing for legal reasons. Any consent that has been given may be revoked at any time with effect for the future.

AMENDMENT OF THE DATA PROTECTION DECLARATION

This data protection declaration does not require the consent of website users, customers, business partners, their employees or other contact persons. It is merely information about the type, scope and purpose of how AQIPTECH AG uses personal data. AQIPTECH AG is entitled to unilaterally change the content of this data protection declaration at any time and without giving notice.
This data protection declaration is structured in accordance with the requirements of the EU General Data Protection Regulation (“GDPR”) and the Swiss Data Protection Act (“DPA”). It is, however, dependent on the individual case whether and to what extent these laws are applicable.
